APPEAL

(Section 11 sub-section 1 of Seed Act 1966) 

 

Any person aggrieved by a decision of a Certification Agency under section 9 or section 10 of Seed Act, 1966 may within 30 days from the date of which the decision is communicated to him and on payment of such fees prefer an appeal to the Appellate Authority. 

 

Appellate Authority

 

Appellate authority was formed as per Sub-section 1 of Section 11 of Seed Act 1966.

 

Appellate Authority may entertain an appeal after the expiry of said period of 30 days if it is satisfied that the appellant was presented by sufficient cause from filing the appeal in time.  

 

On receipt of an appeal under sub-section (1) the appellate authority shall, after giving the appellant an opportunity of being heard, dispose off the appeal as expeditiously as possible.

 

Every order of the appellate authority under this section shall be final. 

 

The appellate authority shall follow the same procedure which a court follows in deciding appeals from the degree or order of an original court under the Code of Civil Procedure 1908 (on part VIII of Seed Rules 1968). 

 

In Tamilnadu the appellate authority comprises of one Chairman and two members.  The Director of Seed Certification is the Chairman and the other two members are technically qualified seed producers and Government of Tamilnadu appoints them.  

 

The members of the appellate authority shall, unless their seats become vacant earlier by resignation, death or other wise, be entitled to hold office for three years.
